Abstract
The article is devoted to the peculiarities of taxation of business income of individuals carrying out transactions with real estate; it analyzes the criteria by which tax authorities qualify income as business; it was concluded that for qualifying income as business, the presence or absence of the status of an individual entrepreneur for an individual does not matter, and the key importance is the nature of the activity itself; it was also concluded that in the absence of individual entrepreneur status, but when the income is classified as business, the tax rules that apply to individual entrepreneurs are applied to an individual.
